Welcome to OrderEase. These Terms of Service ("Terms") govern your use of the OrderEase platform ("Platform"), including our website, ordering tools, and services. By accessing or using our services, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the Platform.

2. Who We Are

Smart Kitchen Co (Pty) Ltd, trading as OrderEase ("we", "us", "our"), provides software that enables customers to order food and goods directly from participating restaurants and stores. We facilitate transactions but are not a food preparer, seller, or delivery provider ourselves.

3. Eligibility

You must be at least 18 years old to use this platform. By using our services, you confirm that you are legally capable of entering into binding agreements.

4. Your Account

To access certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your login details and for any activity on your account.

5. Orders and Payments

• You place orders directly with merchants through the platform.
• Prices are shown in South African Rand (ZAR), inclusive of VAT unless otherwise stated.
• Payments are processed by third-party providers. We do not store your card details.
• Orders may be cancelled by the merchant if items are unavailable or there are operational issues.

6. Delivery

• Delivery is handled by integrated third-party courier services. Times are estimates and not guaranteed.
• It is your responsibility to ensure someone is available to receive the order.
• Failed deliveries due to incorrect information or customer unavailability may incur additional charges.

7. Cancellations and Refunds

• Cancellations must be made before order preparation begins.
• Refunds are subject to the merchant's refund policy and at their discretion.

8. Acceptable Use

You agree not to:

• Use the platform for unlawful purposes
• Attempt unauthorised access to any part of the system
• Interfere with or disrupt the service for other users
• Copy, modify, or reverse engineer any part of the platform

9. Privacy

Our Privacy Policy explains how we collect and protect your data under the Protection of Personal Information Act (POPIA).

10. Intellectual Property

All content, branding, software, and design on the Platform remain the property of Smart Kitchen Co (Pty) Ltd or its licensors. You may not use, copy, or reproduce any material without written permission.

11. Limitation of Liability

OrderEase is not liable for:

• Delays or issues caused by merchants or couriers
• Losses resulting from unauthorised access to your account
• Any indirect, incidental, or consequential damages

12. Changes to These Terms

We may update these Terms periodically. Updated terms will be posted on this page with a revised effective date.

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Disputes will be subject to the jurisdiction of South African courts.
